Kelly Rutherford Lost Custody Because the Judge Thought She Would Abduct Her Kids

More details have emerged as to why former Gossip Girl star Kelly Rutherford lost custody of her two children.

ICYMI: Yesterday a European judge awarded custody to Rutherford's German ex-husband Daniel Griersch and will only allow the Hollywood star to visit with them in France or Monaco.

But now TMZ claims the judge believed the 47-year-old actress might take her American-born kids back to the US and never return.

The site says they have in their possession a written ruling by the judge saying there was "a strong risk of the children's abduction and retention in the United States."

The judge's reasoning may have been influenced by the fact that Kelly failed to return her kids to Monaco following their summer stay in the States. At that time a New York judge ordered them back to Europe to live with their father.

Kelly and Daniel married in August 2006 and welcomed their son Hermes two months later. She filed for divorce in December 2008, while pregnant with their daughter Helena.

They have been locked in a contentious custody battle ever since.

While yesterday's ruling gave Griersch full custody, Rutherford has appealed and is expected to be back in court later this week.
