Kelly Rutherford Loses Custody, Kids Must Stay in Europe with Ex

Former Gossip Girl star Kelly Rutherford has lost custody of her two children.

In a final ruling in the long battle, a Monaco judge has ruled in favor of her German ex-husband, Daniel Giersch, by granting him full custody of nine-year-old Hermes and six-year-old Helena, reported the Daily Mail.

According to the publication, the American-born children will live with Giersch in Europe and Rutherford is only allowed to visit with them in France or Monaco.

Both parents must work together to make decisions regarding the children's "‘health, schooling, religious education and any change of residence."

In addition, the 47-year-old actress will receive $3200 a month in child support.

This final blow comes as Rutherford has been embroiled in a bitter custody battle since splitting with the German businessman in 2008.

In 2012, a California judge ordered the children to live with their father in Monaco after his visa had been revoked. At the time, Rutherford was allowed to bring the kids to United States for weeks on end.

But earlier this year, a New York judge ordered the kids back to Monaco after Kelly failed to return them following a summer stay in the States. The children have been with their father ever since.

Kelly and Daniel married in August 2006 and welcomed their son Hermes two months later. She filed for divorce in December 2008, while pregnant with their daughter Helena.

In 2013, the Hollywood star filed for bankruptcy after reportedly incurring over $1.5 million in legal fees due to the ongoing custody battle.

According to the Daily Mail, Rutherford's legal team is filing an appeal.
